Martial arts have been practiced for centuries for various reasons, such as exercise, mental discipline, sport, and self-defense. Self-defense is one of the primary reasons people learn martial arts, but the question of whether it is legal to use martial arts in self-defense arises. Modern martial arts are descended from hand-to-hand combat styles (and other types of fighting) across cultures and millennia used to fend off attacks and inflict bodily harm or death. Everyone, including an experienced martial artist, has a right to defend him/herself in the event of an attack. Here’s what you need to know about protecting yourself in a fight legally as an experienced martial arts practitioner.

Registering Your Martial Arts Skills 

First of all, Guam is the only U.S. territory where martial arts experts are required to register:

“Any person who is an expert in the art of karate or judo, or any similar physical art in which the hands and feet are used as deadly weapons, is required to register with the Department of Revenue and Taxation.”

Guam Ann. Code Title 10 Ch. 62 § 62100

Refusing to register yourself as a trained martial artist in Guam is against the law. Once registered, if you’re convicted of using martial arts to assault someone, you are automatically guilty of aggravated assault.

When Hand-to-Hand Combat for Martial Arts is Legal Self-Defense 

In the United States (and in many other countries), self-defense is considered a legal defense if one uses force to protect oneself from an imminent threat of bodily harm or death. However, the law requires that the use of force must be proportional to the threat posed. You are also legally allowed to defend others with your martial arts, provided, again, that your response is proportional. This means that the level of force used in self-defense should not exceed what is reasonably necessary to repel the attack. As a martial artist, you must be fully aware of the consequences of intentionally or unintentionally misusing your skills. Even though you may be capable of grievously injuring or killing an attacker, the law does not allow you to do so if the use of force is deemed excessive. Using excessive force can result in assault and battery charges.

Each case is reviewed individually and subjectively as to whether the threat to your safety incurring your use of martial arts was warranted – sometimes the threat is so obvious as to be unquestionably warranted, such as assault with a deadly weapon. 

As a martial artist, you want to first make every attempt to neutralize a threat without resorting to using your martial arts skills. You can only safely use your martial arts skills to repel the attacker once every other method of defusing the threat has failed (leaving the scene may be an option in some cases). Only use the amount of force necessary to neutralize the threat without causing any further injury. 

Legal Consequences for Using Martial Arts Wrongfully in Self-Defense

If you use your martial arts skills against a threat that is non-imminent or nonproportional to the amount of force you used, you could be held criminally liable for excessive and disproportionate use of force, and you may be arrested and charged with criminal assault. 

Misdemeanor assault can result in:

  • A probationary sentence
  • A fine of several hundred dollars
  • Short-term incarceration

Felony assault charges can result in:

  • A fine of several thousand dollars and 
  • Long-term incarceration
  • Life imprisonment

If you can safely walk away from a confrontation, that’s always the best course of action. If a physical altercation with someone is unavoidable: 

  • Warn the attacker that you intend to fight back. 
  • Do not strike until it is absolutely necessary.
  • Use appropriate force for the attacker and for the attack itself.
  • Plan how you would respond to an attack before you have to do it in real time.
  • Each state has different laws governing self-defense. If you’re an experienced martial artist, it’s your responsibility to know the laws governing whatever state you’re in.

From Corn Fields to the Cage: A Spotlight on Coach Jason Somchay

Just as important as tradition is to martial arts, so are those who take on the responsibility of teaching them. That’s why Florida Kickboxing Academy is so proud to have some of the best trainers in the world partnering with us. One of those trainers is Jason Somchay. Born and raised in Nebraska, we are so fortunate that he made his way to Florida to share his love of the self-defense system known as Muay Thai.

“Martial Arts is Everything To Me” 

Jason was raised by his grandparents who came to the Midwest as refugees of the Vietnam War. Martial arts and self-discipline were a daily part of Jason’s upbringing. He grew up in his Tecumseh, Nebraska home kicking rice bags and learning (and taking!) teeps from both his grandmother and his grandfather. One of his fondest memories is of watching Muay Thai on satellite television with his grandmother. Muay Thai is prominent in Southeast Asia and his Laotian grandparents made sure to continue the tradition with Jason.

His Laotian blood aided him in quickly picking up whatever sports and fitness training he tried. He played American football and basketball and competed in wrestling. With an affinity for the spotlight, he was also involved in the performing arts. He could be seen singing in the choir and even breakdancing in his local community.

Family, Florida, and Fitness Training

Times of adversity, encouragement from athletic coaches, and opportunities to compete brought Jason out of his shell and he took a leap of faith. In 2005, he made the move to South Florida, following his uncle. His uncle had just become an MMA fighter and was acting on several shows based in Florida. He took the opportunity to corner his uncle’s MMA fights and it wasn’t long before the cage lights took Jason in.

In 2008, Jason had his first MMA fight. He knocked his opponent out in 17 seconds. It was in that moment that Jason knew that there was a door of opportunity opening for him in the world of Muay Thai and martial arts. He continued fighting in Muay Thai and MMA and in 2012 he went professional. Still with a heart for performing, showing his skills in the ring brought both joy and fulfillment into Jason’s life.

Passing on the Tradition of Self-Discipline

After competing in 40+ fights over 15+ years, Jason made the decision to share his knowledge with others and began coaching Muay Thai. He is passionately passing along his experience to his students while still enjoying a bit of the cage light at the same time. He aspires to be an inspiration to all he comes in contact with and wants to continuously develop more and more champion fighters. He works with students of all skill levels and experience and strives to make each of his students into the best version of themselves.

What Is Muay Thai?

What is Muay Thai? Muay Thai boxing is known as “the art of the eight limbs.” These eight limbs are your two hands, two fists, two knees, and two feet – your weapons in the ring. Muay Thai History

Muay Thai’s history begins centuries ago in Thailand, and today it is the country’s national sport. Muay Thai’s definitive origins are debated by modern scholars because much of Muay Thai history was lost when the Burmese army ransacked the Siamese capital, Ayudhaya, in the 14th century. 

In 695 C.E., the Siamese created their very first army in the northern city of Sukhothai in order to defend themselves from the attacks of neighboring tribes and kingdoms. Soldiers were taught how to use their entire bodies as a weapon. This Muay Thai training evolved from Krabi Krabong, literally translated as “long and short weapons,” the previous weapons tactics of the Thai army. 

To practice, different companies within the Siamese army went up against each other in unarmed combat (Muay Boran) with few rules, no weight divisions, and no time limits. The rudimentary elements slowly turned into precise techniques – such as stand-up striking – through the experiences of training, military exercises, combat, and loss of life. The goal of each strike and movement is to deliver a debilitating blow that enables the fighter to quickly overcome his opponent while never himself becoming vulnerable. Veteran soldiers taught novices offensive and defensive tactics, proper posture and positioning, and methods for enhancing awareness, and the lessons continued on throughout the generations of Thai fighters.

Evolution of Muay Thai Training

Learning the traditional values that Muay Thai training instilled in young men became a staple of early Siamese culture. The first Muay Thai training camps sprung up all over the country in order to prepare citizens for war. Some Buddhist monks even taught Muay Thai at Buddhist temples. Muay Thai eventually became a martial art associated with royalty and the aristocracy as well. The two sons of King Phokhun Sri In Tharatit, the first King of Sukhothai, were sent to learn Muay Thai, with the idea that good warriors made brave leaders and that it would prepare them as future rulers.

The “Golden Age of Muay Thai” came in the 1880s. King Rama V enthusiastically promoted Muay Thai training as a way to stay physically fit and learn traditional values. He promoted tournaments and “Muay Luang,” or royally-appointed boxing centers, throughout the kingdom. It served as a way for him to scout men who would make good bodyguards or royal military officers. Many times the top fighters at these royal centers would receive personal invitations from the King to fight at tournaments, festivals, and important international events. And when The Thai Department of Education was created in 1887, Muay Thai became part of the Military Cadet teachers’ school curriculum.

Muay Thai Comes to Europe and Beyond

Muay Thai was introduced to Europe and the rest of the world during World War I. Thai commanders would organize Muay Thai bouts for their troops stationed in France to boost morale, and French soldiers would try to compete against the Thai fighters. The first permanent Thai boxing stadium was built at the Suan Khoolab School after the war. It was during the time after the war that time limits, boxing gloves, and a uniform set of rules were introduced to Muay Thai. 
The oldest and largest Muay Thai organization in the world, The World Thai Boxing Association (WTBA), was founded in 1968 by Ajarn Surachai “Chai” Sirisute. (Ajarn is Thai for head instructor.) Ajarn Chai came to the United States intending to spread the art of Muay Thai throughout the world. He was the first-ever Thai boxing instructor to teach Americans Muay Thai. But it didn’t stop with him. His training brought more and more teachers and masters in the United States. Schools and federations began popping up all over the country, carrying the tradition with them. Today, Muay Thai is a very popular martial art all over the United States, and Florida Kickboxing Academy is pleased to list Muay Thai on its roster of excellent classes.
